Welcome to Lumisara ("Lumisara", "we", "our", "us"). By accessing or using our websites, subdomains, tools, research, newsletters, or any related services (collectively, the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.

1 General Information

Lumisara is an Australia-focused consultancy serving the superannuation and wealth ecosystem.

Business audience only

The Site is intended for business and professional users (e.g., superannuation funds, wealth firms, fintechs, policy and research teams). It is not directed to retail consumers and is not consumer marketing or a retail offering. The Site is not intended for use by "retail clients" as that term is used in the Corporations Act 2001 (Cth).

General information only

Content (including research, articles, tools, and calculators) is educational and illustrative. It does not take into account any person's objectives, financial situation, or needs. Nothing on the Site is financial, investment, legal, tax, or actuarial advice, a recommendation, or an invitation to buy/sell any product. You should seek advice from appropriately qualified professionals.

No AFSL; no financial services

Unless expressly stated otherwise, Lumisara does not hold an Australian Financial Services Licence (AFSL) and does not provide financial product advice, deal in financial products, arrange for others to deal, or issue/distribute any financial product disclosure (e.g., PDS/FSG). We also do not provide credit assistance under the National Consumer Credit Protection Act or registered tax agent services.

No reliance

Any use of Site content is at your own risk. Calculators and models are simplified and illustrative only and may not reflect actual outcomes. Always verify independently.

2 Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You must not:

  • Breach any applicable law or regulation (AU or otherwise).
  • Access or attempt to access non-public areas, interfere with security, probe/scan systems, or perform load tests without written consent.
  • Scrape, harvest, or use automated means to access the Site or its content without our prior written permission.
  • Introduce malware or otherwise disrupt, degrade, or overburden the Site.
  • Misrepresent your identity or affiliation, or infringe third-party rights.

We may suspend or terminate access (temporarily or permanently) if we reasonably believe these Terms have been breached.

3 Information Accuracy & Calculators

We strive for accuracy and currency, but content may be incomplete, out of date, or contain errors. Calculators and tools are illustrative, rely on assumptions, third-party data, and simplifications, and may not reflect your circumstances or future outcomes. You use the Site at your own risk and should verify results independently.

4 Third-Party Links, Embeds & Services

The Site may link to or embed third-party websites, forms, analytics, charts, or newsletter tools. We don't control or endorse third-party content, policies, or practices and are not responsible for them. Your use of third-party services is governed by their terms and privacy policies.

5 Intellectual Property

  • All content on the Site (including text, graphics, logos, trademarks, layouts, code, data visualisations, and tools) is owned by Lumisara or its licensors and is protected by copyright, trademark, and other IP laws.
  • You must not reproduce, distribute, adapt, reverse-engineer, or create derivative works from the Site or its content unless permitted by law or with our prior written consent.
  • You may link to public pages of the Site in a fair and legal manner that does not damage our reputation or imply endorsement.

6 Privacy & Communications

Your use of the Site is also governed by our Privacy Policy. By contacting us, signing up for newsletters, or using forms, you consent to receiving communications consistent with this policy. You can unsubscribe at any time.

7 Australian Consumer Law (ACL) & Warranties

  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law that cannot be excluded.
  • Subject to those non-excludable rights, the Site is provided "as is" and "as available," and we exclude all warranties (express or implied) regarding accuracy, timeliness, reliability, availability, merchantability, fitness for purpose, or non-infringement.
  • Where our liability for breach of a consumer guarantee can be limited, our liability is limited (at our option) to resupplying the relevant services or paying the cost of having the services resupplied.

8 Limitation of Liability

To the fullest extent permitted by law, Lumisara, its directors, employees, contractors, and contributors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of data, or business interruption, arising out of or in connection with:

  • your use of or reliance on the Site or its content;
  • errors, omissions, or outdated information;
  • interruptions, security incidents, or unauthorised access; or
  • third-party sites, services, or content.

Where liability cannot be excluded by law, it is limited as set out in Section 7.

9 Indemnity

You agree to indemnify and hold harmless Lumisara and its contributors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Site; (b) your breach of these Terms; or (c) your violation of any law or third-party rights.

10 User Submissions & Feedback

If you provide suggestions, feedback, or content ("Submissions"), you grant Lumisara a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, adapt, and publish such Submissions for any purpose, without attribution or compensation, unless we agree otherwise in writing. Do not share confidential or proprietary information unless we have a separate written agreement.

11 Changes, Availability & Termination

  • We may update these Terms or any part of the Site at any time. Material changes to the Terms will be reflected by the "Effective Date" above. Your continued use after changes constitutes acceptance.
  • We may modify, suspend, or discontinue the Site (in whole or part) without notice. We are not liable for any unavailability or modification.

12 Governing Law & Disputes

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of VIC and Australia.

13 Miscellaneous

Severability

If any provision is invalid or unenforceable, the remaining provisions remain in full force.

No waiver

A failure to enforce a right is not a waiver of that right.

Entire agreement

These Terms constitute the entire agreement between you and us regarding the Site and supersede prior understandings relating to the Site.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction, including as part of a reorganisation, merger, or sale.

15 Acknowledgment

By using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
